A "mortgage contingency clause" is a provision in the home purchase contract that says that if the prospective buyer can’t get a mortgage within a fixed period of time, s/he can call the whole deal off.
1.不可人为控制
first-time home buyers误以为可以通过mortgage contingency反悔,跑出来。可实际上我们中国人实在太干净了,想拿着deposit跑出来几乎不可能。我碰到过一单客人发现seller有问题,不想要这个房子了。尽管律师,loan officer和我悲壮的齐使劲,但也没发生。我们中国人几乎家家不差钱,又不欠钱,想不批Loan谈何容易。所以inspection之后,一定要想好要不要,过这个村就没这个店了,再想跑就难了。除非你在工作上作文章,公司说你明天就没工作了,正等着开你走人呢。还要和你的老板和human resource的人提前串通好了。

2.commitment letter之后的时光
这个contingency能保你多久?通常出commitment letter的时间是距离签P&S三到四个星期。一旦银行approve了,从此以后到closing这段时间,你就自求多福了。在此期间,如果你丢了工作,你的几万块Deposit就打水漂了。所以最稳妥的办法是把closing date和commitment letter的时间贴的近一点,空房子seller很高兴你快快的close,住在里面的seller就不干了。他望眼欲穿终于等到了银行的commitment,还没等容功夫高兴高兴,紧接着就被buyer砸门逼着搬家了。
一个seller生气的对我们吼“commitment一个星期你就让我搬家,我找房子都来不及。”

3.工作状况的核对
有的银行closing的前几天会核对你的工作情况,我碰到过一单closing的前一天被Layoff,银行没查就给close了。身份有的时候是个尴尬的问题,如果你刚换了工作,H1-B还没来得及换成现在的雇主,就又麻烦了。

In 2006, i hired an inspection company and checked the house in good condition, I made offer and paid $20,000 as earnest money. 1 Day later, i discussed with my parents, thought the house is not good for XXX reason, so told my broker, and she immediately contacted the seller and get me back full amount of $20K.

She said in US, if you are seller side, once offer agreed, no withdraw possible unless you are willing to repay buyer of the earnest money without sell the house tohim/her...But, however, if you are the BUYER, you have 10 days (grace period), you can back out this offer in this 10 days...

Just a note here....

agree, sometimes the seller's agent only get a fax/photo copy of the check in buyer's offer letter.

我碰到过好几单seller反悔不卖的,我认识的朋友在给seller10000还是打官司花律师费之间,选择了给seller钱。没什么办法,因为托不起官司,扯不起皮。理想和现实之间是有差距的。

seller“no withdraw possible”也谈不上,退出押金显然是必须的,然后退出了seller也没什么损失呀,可能会被告到法庭而已。

如果seller也要交押金就好了。
